The terms and conditions for this Competition have been deposited with Athens-based notary public Haralambos Fotopoulos, 47 Solonos St., 106 72, tel. 210 3617704, and Deed No 1833/10.12.2021 has been drafted regarding the deposit of the Terms of Participation in the Competition.
- Scope of the Competition – Organisation: The company with the corporate name "AEGEAN AIRLINES S.A.", whose registered offices are at 31 Viltanioti St., Kifissia, Attica (hereinafter the "Organiser"), is staging the promotional campaign - competition “Make your purchases at Hellenic Duty Free Shops and enter the draw to win special gifts” (hereinafter the "Competition"), via Hellenic Duty Free Shops in Greece and online at https:// shopdutyfree.com via Reserve & Collect service by Hellenic Duty Free Shop. The Competition starts on Friday 10 December 2021 at 09:00 and ends on Monday 10 January 2022 at 24:00. Five (5) lucky winners will be chosen through a draw to be held on Thursday 13 January 2022. The Organiser invites the members of the AEGEAN and Olympic Air Miles & Bonus frequent flyer programme, who will make purchases at Hellenic Duty Free Shops and will present their Miles+Bonus card and earn or redeem the corresponding award miles during the term of the Competition, to take part in a draw, after reading the complete terms and conditions of the competition through AEGEAN’s website. The 5 winners of the Competition must provide identification information matching the details of the AEGEAN Miles+Bonus card that they presented at the cash registers of Hellenic Duty Free Shops upon completion of their purchases, which were entered in AEGEAN’s system through Hellenic Duty Free Shops cash register systems and which will result from the draw to be held by AEGEAN through the website www.random.org on 13 January 2022 at 15:00. The winners must be individual AEGEAN Miles+Bonus members who purchased products at physical or through the Reserve & Collect Service of Hellenic Duty Free Shops and earned or redeemed the corresponding award miles during the term of the Competition. Participation in the Competition is only possible through purchases at physical or through Reserve & Collect service of Hellenic Duty Free Shops in Greece with presentation of the Miles+Bonus card to the cashier of the store upon completion of the transaction. Each participant takes part in the draw automatically upon completion of the transaction, and only if he/she has earned award miles from the transaction. The Organiser assumes no obligation to secure or facilitate access to Internet sites or to provide the relevant facilities to any interested party with respect to their participation in the Competition. Access to the Competition website is only permitted under the operating terms and conditions for the relevant server and the technical and other conditions and specifications for the Competition. The Organiser considers that each participant is the holder of and has exclusive control over the personal data provided. The Organiser shall not be liable for any charges to the participants/users arising from the aforementioned grounds.
- Eligibility
Anyone over the age of 18 is eligible to participate in the promotional campaign / Competition. Individuals falling into the following categories are excluded from the Competition: (a) anyone under the age of 18; (b) anyone who has expressly not agreed to these terms and conditions of use; (c) employees of the Organiser; (d) employees of companies affiliated with the Organiser; and (e) first- and second-degree relatives of the employees referred to in paragraphs (c) and (d) above and the spouses of said employees. In the latter case, the aforementioned Companies will not be liable to anybody due to inappropriate use of this service. The Organizer reserves the right (but is not required) to exclude from the Competition, at any stage thereof, persons who, in its view, may have used (or attempted to use) unlawful means regarding their participation or who breach any term of this article. Unlawful means shall mean, inter alia, cooperation with other persons, use of devices, arrays, computers and/or software to facilitate automated or multiple participations without human intervention, and so on. In all events, the Organizer may exclude any user/visitor/participant from the Competition using any lawful means. It is hereby specified that participation in the Competition does not require purchase of any product and that no fee is to be paid by the participants. Participation in this promotional campaign is conditional upon access of the participants to the Internet using their own technical means. It shall be voluntary and requires prior agreement of the participants with the terms of the Competition.
- Prizes - Draw: The following two (2) prizes will be drawn after the end of the Competition at five (5) lucky winners:
• 20,000 award miles for 5 lucky winners, which will be credited to their Miles+Bonus account. An electronic draw from among all participants will be conducted to select the winners.
• Hellenic Duty Free Shops vouchers 200€ for 5 lucky winners which could be redeemed through the Reserve & Collect service via https://shopdutyfree.com. Prerequisite is that winners need to travel for collecting their gift purchases.
The draw will be held at the Organiser’s registered offices, on Thursday 13 January 2022 at 15:00. Five (5) winners will be drawn. The Organizer will process the entries in the competition and conduct the draw for the winners. The web tool to be used for the draw is http://www.random.org/. Any participant can be declared a winner only once and receive his/her Prize only once. The winner of the Competition may not designate a substitute to receive the Prize nor request exchange of the Prize against money or any other replaceable items. The Organiser reserves the right to announce the name of each winner through Facebook, SMS, publication in magazines, newspapers, on the Internet and at the company’s offices. By participating in the Competition, participants are presumed to have granted their consent to such disclosure of their names. The Organiser reserves the right to request from each winner to give his/her written consent, at the free and uninfluenced will of each winner, for the use of their minimum personal data necessary on the Competition webpage or in the context of any other promotional action related to the Competition.
- Terms and conditions of award of the prizes:
4.1 Terms of award of AEGEAN Miles+Bonus miles
• The miles awarded are award miles, not tier miles.
• The miles will be credited to the Miles+Bonus account from which the mile-earning transaction was made.
• Miles are strictly personal and cannot be transferred or assigned to any third party, nor can they be exchanged for money.
• Miles will be credited to the winners’ accounts within 10 working days of the date of their notification.
4.2 Terms and conditions of award of Coffee Island vouchers
• The total value of each Hellenic Duty Free Shop voucher prize is €200. The voucher promo code could be used at Hellenic Duty Free Shops website through Reserve & Collect service. To redeem the promo code voucher you should enter the promotional code at the respective promo code field during payment step.
• The winners have to pick up the products/gifts at the airport before flight.
• Hellenic Duty Free Shop voucher can be used up to 31/12/2023.
• A Hellenic Duty Free Shop representative will directly contact the winners to inform them about the gift delivery, within 5 working days since the winners’ announcement at AEGEAN website.
- Date of start-end of Competition/promotional campaign – Duration:
The Competition/promotional campaign will start Wednesday 01 December 2021 at 09:00 and will end Monday 10 January 2022 at 24:00. The Competition computers (including any automated subsystems – count-down web tools made available to the Organiser) shall be the official timer of the Competition determining the Start Time, the End Time as well as the time an entry in the Competition is actively sent. It is hereby explicitly specified that, after the end date and time of the aforesaid Competition/promotional campaign, as announced in the terms of use of the Organiser’s page and posted on Aegean’s website during the last Competition procedure, no participation shall be accepted by, or be binding upon, the Organiser as far as participation in due time is concerned.
- Change of terms and conditions of use:
The Organiser reserves the right to amend these terms at its discretion, informing visitors/users about any amendments and changes through the Competition/promotional campaign webpage at www.aegeanair.com
- EXPRESS DECLARATION – CONSENT – ACCEPTANCE BY THE PARTICIPANTS:
All participants in the AEGEAN Miles+Bonus program hereby fully and unreservedly accept these terms and conditions of use. Persons who do not accept the terms and conditions of use should not participate in the AEGEAN Miles+Bonus program. Furthermore, all participants explicitly and unreservedly acknowledge, state and accept that: (a) the personal data provided in the context of this promotion may not belong to any third party, whether a natural person or legal entity, but only to themselves; (b) they are over the age of 18; (c) their privacy is neither violated nor degraded in any manner whatsoever due to their participation in the Organiser's promotional campaign; (d) they do not infringe personal data or privacy rights of any third party; (e) they do not infringe intellectual property rights of any third party; (f) they expressly consent and allow the Organiser to use their personal data (full name, telephone, e-mail address) for the purposes of the Competition.
- Publicity:
The terms of participation in the Competition have been deposited with Athens-based notary public Haralambos Fotopoulos, 47, Solonos St., Athens GR-10672, tel. 210 3617704, and have been posted on the Competition webpage www.aegeanair.com. The draw will be held at the Organiser’s registered offices, on Thursday 13 January 2022 at 15:00. Five (5) winners will be drawn. Any participant in the Competition or any third party may obtain an exact copy of this deed or any amendment thereto at own expense.
- Withdrawal of Notice – Amendment of Terms - Liability:
The Organiser shall be entitled to withdraw the Competition notice, in whole or in part, or to amend these terms (including the duration of the Competition and the dates of conduct of the draws), or to change the Prizes offered during or after the Competition. In this case the Organiser shall bear no liability whatsoever for any compensation to third parties or with regard to the winners of that draw. The Organiser shall bear no liability under any circumstances for any direct or indirect losses, expenses or costs which may arise from any interruption, malfunction, delay or any other reason, concerning the Competition prizes. Furthermore, the Organiser hereby waives all liability, whether criminal or civil, to any winner or third party, for any accident and/or loss and/or bodily injury or material damage that may occur to the winners, directly or indirectly, relating to the Prizes or arising from any other cause. It is expressly understood that, after the end of this Competition or after the new date that may be set following any postponement or change in the duration of the Competition, entries shall no longer be possible and any entries submitted shall automatically be considered null and void and shall not be binding on the Organiser and/or any other third party. In that case, by participating in this promotion, participants irrevocably accept that they do not acquire any right or claim against the Organiser nor do they become entitled to demand continuation of the Competition that has ended or delivery of the Prizes not awarded or any further compensation. Participants shall neither have nor acquire any rights whatsoever in respect of the trade marks, names, marks, logos and other insignia of the Organiser.
- Personal Data - Express Consent: Regarding the Organiser Participation of any person in this Competition automatically implies the participant's unreserved consent to the Organiser for monitoring and carrying out the competition using their details, to create personal data files (personal data). The database created as a result of this Competition may be used by the Organizer for promotional purposes in the future to promote its own services. Participants in the Competition expressly agree to the Competition database being handed over by the Organiser to the company responsible for monitoring and carrying out the Competition and vice versa.
- Applicable Law – Jurisdiction: These terms and conditions and all types of contractual and non-contractual relations arising as a result of their implementation shall be governed by Greek law for all participants. Any dispute to arise in the future in relation to this Competition shall be referred exclusively to the Courts of Athens, including by non-permanent residents of Greece.
ANNEX – "STATEMENT OF CONSENT"
Participants state that they have gained thorough knowledge of all Terms of the promotional campaign and that they unconditionally accept such Terms in their entirety. Each participant states that he/she holds no claims whether current or future, against the Organiser or its executives, employees or performance agents with respect to the running of this Competition, the implementation of its terms or any other cause relating directly or indirectly to the Competition. Each participant explicitly consents and agrees to the simultaneous assignment and full and final transfer to the Organiser, free of charge, of any and all intellectual property rights or related rights over the visual material described above. The Organiser shall be entitled to exploit such visual material in any manner for the creation of on- and off-line advertisements, for the internet and/or for the press or the television.
PRIVACY STATEMENT
The company AEGEAN AIRLINES S.A., whose registered offices are at 31 Viltanioti St., Kifissia Attica (hereinafter the Company) is the data controller for your personal data in the context of your participation in the promotion entitled “Make your purchases at Hellenic Duty Free Shops and enter the draw to win special gifts”. Since it is our strategic aim to ensure that participants’ data enjoys maximum protection, we feel obliged to inform you both about our practices, and the choices and the rights you have.
I. What personal data do we collect?
For your participation in the Competition, our Company collects and processes your name, your e-mail address and date of birth, which you provide yourself in the relevant forms of participation in the Competition.
II. For what purposes is personal data collected and processed?
We collect and process your personal data solely to enable you to participate in the Competition and to identify you. In the next stage, if you are declared the winner, we will process your personal data only if you have given us your express consent so that we can promote the Company's activities to the general public. In particular, our company will process the following data (name, e-mail address) on any of the company's online and offline channels (Internet, mobile applications, third party websites, Social Media, YouTube, Airport Monitors, inflight Entertainment programs, etc.), as well as the Internet, for as long as and wherever deemed necessary by the Company. In addition, if you expressly wish us to do so, and have completed the relevant consent field on the participation form, our Company may process your data to promote products and services to you by e-mail.
III. Who do we disclose and/or pass on your personal data to?
Our Company may transfer, disclose, or grant access to your personal data to companies operating in its name and on its behalf, in order to help it achieve its purposes.
IV. How do we protect your personal data?
To ensure that the personal data collected is used properly and kept safe, and to prevent unauthorised or accidental access, processing, deletion, corruption or other use thereof, the Company implements various internal policies and takes all necessary organisational, technical, physical, electronic and procedural security measures and applies technological standards in accordance with the applicable laws and regulations.
V. How long will we retain your personal data for?
We shall retain your personal data for as long as necessary in order to fulfill the purpose for which you have provided your consent. Your data is then removed from our files and system, in compliance with our company policy and provided that retention is no longer required to meet the purposes outlined above or to meet business, tax or accounting requirements or to defend our rights before any competent court or any other authority.
VI. What are your rights? You are entitled to request and receive access to, update, and obtain a copy of your personal data which we collect and process. If you want a copy of all or part of your personal data please contact us at the company’s contact details set out in the relevant section hereof “VII. How can you contact us?”. Moreover, we would like to inform you that you have the right to ask for your personal data to be erased if (a) it is no longer necessary to fulfil the purposes of our contractual relationship, (b) the data was unlawfully processed illegally and outside of the purposes set out in detail herein, (c) it is required by law. You are also entitled to withdraw your consent (in whole or in part) to the collection and processing of your personal data by our company. In that case, you need to bear in mind that any withdrawal of consent does not in any way affect the legality of the processing up to the moment of withdrawal. Consequently, you can freely withdraw any or all consent given at any time by submitting your written request to the email address provided below in term “VII. How can you contact us?”, so that the photographs and/or the audiovisual material in which you appear will be deleted and as a winner only your name will be mentioned. Please note that the said deletion obligation obviously does not apply to photographs that have already been included in previously released material. In addition, in the case of photographs/audiovisual material where more people are depicted, your refusal to consent to your appearance or the subsequent withdrawal of your consent does not entail the destruction of all photographs/audiovisual material but only the blurring of your own image (face and body) so that the person being depicted is not identifiable. If consent is withdrawn, we will take reasonable measures to inform third party processors who have processed the data.
